A man convicted of molesting a three-year-old boy at a Verdun daycare will find out his fate today.
Andrew Phillips, 26, was found guilty in July of sexual interference for having touched the genitals of the boy while he attended the daycare in 2012.Phillips was working as a substitute child care educator at the time.
On Tuesday, lawyers from both sides presented a recommendation that Phillips be sentenced to a 15 month prison term. Quebec Court Judge Julie Riendeau said she would decide whether or not she agrees with the recommendation Wednesday.
The boy told his parents that Phillips had touched his penis, which they originally thought was an accident because he was potty training at the time. The same story was told to his aunt, who called police. The boy told investigators that it happened multiple times while he was supposed to be taking a nap at the daycare.
Phillips denied the allegations, but Judge Riendeau believed the child, even though some parts of his testimony had been exaggerated, such as the exact number of times he was touched. Judge Riendeau said the rest of the testimony was accurate and corroborated by evidence.
Phillips is appealing the decision.
