The city of Montreal is going after ex-mayor Michael Applebaum who doesn't want to give back the $160,000 transition allowance he received after stepping down from his post.
Applebaum was given the money after his resignation that followed his arrest in 2013.
Applebaum has since been convicted of fraud, abuse of trust and conspiracy. He served a sixth of his 12-month sentence before being released from jail.
The city cites new legislation that requires former elected officials to reimburse any transition allowance if they are found guilty of fraud or sentenced to two years or more in prison for any other crime.
La Presse reports Applebaum's lawyers have responded to the claim, saying he has no intention of paying the money back.
The city is now asking Quebec Superior Court to order a reimbursement.
