Two Montreal police officers have been found guilty of racial profiling and have been ordered to pay the victim thousands of dollars in damages.
The incident dates back to 2011.
One night in June while delivering food for a local restaurant Davids Mensah, originally from Ghana, was pulled over by two SPVM officers.
During the stop there was some confusion over Mensah's drivers licence and an unpaid fine. As the situation escalated Mensah was handcuffed and put in the back of the police cruiser.
The officers then questioned him, asking three different times if he had drugs or weapons on him. The officers also search Mensah twice.
It was the line of questioning and second search the Quebec Human Rights Commission found to be discriminatory and abusive.
The Commission ordered the Montreal police department to pay Mensah $8,000 plus interest in moral damages and the officers involved, Jean-Michel Fournier and Martin Robidoux, to pay $2,500 and $1,500 respectively.
