The Montreal pit bull battle goes another round today.
The city will file its appeal of Quebec Superior Court Justice Louis Gouin's ruling that suspended its pit bull ban and pit bull-type dog restrictions.
"We will not yield to threats nor interest groups. We reconfirm our intention to ban pit bull type dogs from Montreal" Mayor Denis Coderre wrote in an open letter the day after the judge's decision.
Justice Gouin said in its current form, the new bylaw lacked clarity and appeared to have been written in haste. He invited the city to return to the drawing board to properly define how to identify a pit bull.
The city believes Gouin erred in fact and law and delaying the bylaw could cause serious harm to Montrealers.
When it filed its lawsuit against the city, the SPCA said by implementing the restrictions and ban there would be serious prejudice and harm that would be irreparable.
