Getting a photo radar ticket for speeding seems to have been the straw the broke the camel's back for Quebec City lawyer Jean-Roch Parent.
Parent plans to take on photo radar in court and says he will argue that the process of ticketing the owner of the vehicle rather than the person driving it, is unconstitutional because it removes the presumption of innocence.
Parent tells the Journal de Montreal the way the law is written now the burden of proof is placed on the vehicle owner rather than on the Crown.
He has set up a website that will allow people who have been ticketed by photo radar to to be part of a single court challenge.
The cost is $100.
Parent says since 2009 almost 690,000 photo radar tickets have been issued from Quebec's 151 units generating more than 92$ million in revenue for the government.
