Certain sections of Montreal's highly controversial pit bull ban will not apply, until a final ruling is made on the SPCA's legal challenge of the city bylaw.
On Wednesday, a Quebec Superior Court judge extended a temporary suspension of some of the bylaw's most contentious sections — specifically those prohibiting the adoption of "pit bull type dogs", and requiring muzzles on such dogs.
The temporary suspension, granted on Monday, was due to expire at 5 p.m. on Wednesday.
The SPCA is challenging the pit bull bylaw, arguing that some of its provisions are discriminatory and unenforceable. Of particular concern to the SPCA and its lawyers is the definition of what it is to be a "pit bull type dog", which they believe is much too vague.
Last week, city council votes 37-23 in favor of the bylaw, which also bans new pit bulls from coming into Montreal, and placing restrictions on those already in the city.
