Crown prosecutors have filed an appeal of a municipal court judge's decision to throw out the traffic ticket a Quebec City woman was issued for failing to remain at the scene of an accident.
Audrey Bernard's brush with the law began two years ago, when she accidentally backed into a parked scooter.
She left a note with her name and phone number and drove off.
The Jour4nal de Montreal reports the owner of the scooter called the number but after receiving no answer, he contacted police.
An officer tried the number and when she picked up she explained that she did not hear the phone because it was in her purse.
He then ordered her to return to the scene but she refused saying she was at home making dinner for her three children.
Several days later she got ticket in the mail for failing to tell police about the accident and was fined $400 with the loss of nine demerit points.
The judge said the officer's behaviour was abusive, that by leaving the note the woman had essentially done everything that the Highway Safety Code required and it was not essential for her to meet with the police officer.
