Montreal police say Jeff McCarthy can contest it, but the ticket they gave the bagpiper this month, stands.
McCarthy is planning to fight the fine he was given two weeks ago for carrying the ceremonial Scottish knife and has already spoken to a lawyer about it.
"What I've been doing today is getting all the paperwork needed for the lawyer to start the proceedings." he tells CJAD.
Police meantime, say McCarthy will still need to pay to get his knife back and advise anyone carrying similar knives to keep them hidden when not in dress attire.
McCarthy hopes that this incident will not get in the way of other people wanting to celebrate their Scottish heritage.
